What Controls Release After a DWI Arrest?
North Carolina law separates impairment-based detention from the conditions that must be satisfied before release.
Impairment-Based Detention
Under N.C.G.S. § 15A-534.2, a person may be held when their impairment presents a danger to themselves, another person, or property.
The impairment-based detention may last no longer than 24 hours. Other release conditions, charges, warrants, or holds may still prevent release.
Sober Responsible Adult
A judicial official may allow release when a sober, responsible adult is willing and able to assume responsibility for the person until the impairment no longer presents a danger.
A secured bond or other release conditions may still apply.
Release Conditions
A judicial official determines the conditions of pretrial release. A secured bond may be required, but it is not the only possible release condition.
