American Bail Bonds

Raleigh Bond

American Bail Bonds is here to help with all of your bonding needs.  In our legal system, there are options for requesting a release from incarceration in order to allow time to prepare for a defense case.  There are five basic release options available and they are:

Cash Bail
Cash bail occurs when an individual gives the court the complete amount of bail in cash. The cash offering is to be held by the court.  The cash bail is held until the defendant stands trial and the case is finished. Bail is often returned, in full, if the defendant appears in court for all scheduled dates.

Surety Bond
A surety bond is a contractual agreement by an insurance company that satisfies the value of the bond with sufficient assets.   This insurance company assumes the role of a bail bondsman.  The bail bondsman agrees to pay the bond forfeiture if the defendant fails to stand trial at the designate court dates.  A premium is usually charged for this service and a trusted acquaintance of the defendant must contact a licensed bail bondsman.  The bail bondsman is allowed to accept collateral as assurance that the defendant will appear in court.  The bail bondsman will then post a bond for the complete amount of the bail which will allow release of the defendant pending the outcome of the trial.  If the defendant fails to appear in court, the bail bondsman has is allowed to seek out the defendant and bring them to court.

Property Bond
A property bond occurs when a court allows the defendant to be released and later appear to stand trial while holding property as collateral.  This case is very rare and can result in foreclosure of the property if the defendant fails to appear in court.

Release on Personal Recognizance (P.R.)
This occurs through a county administered release program.  The defendant is interviewed by the program which can make recommendations regarding the defendant’s release.  This method requires no financial security.

Release on Citation (Cite Out)
Release on citation involves the release of the defendant by issuance of a citation by the arresting officer to the defendant.  This citation informs the defendant of his or her court date and usually occurs immediately after the defendant is detained.  Release on citation occurs at the discretion of the arresting officer and requires no collateral or financial security.  Release on citation, as with release on personal recognizance, rely on the integrity of the defendant to appear in court and stand trial as ordered by the judge.  The consequences for failing to appear can include further incarceration and increased fees.
